FantasyXTREME, Inc.
MODEL AGREEMENT
Fantasy XTREME, Inc provides an Internet Website
for the purpose of live video chat by independent performers, which
is made available to businesses, organizations, agencies, referrers
or other third party groups (hereinafter "STUDIO") for
lawful usage. The Studios performers entertain customers accessing
the Website, as described in section 1 of this contract, on the
terms and the conditions stated herein.
USAGE & RESTRICTIONS
1. Some of our Sites have â'Free Chat Areas'.
The STUDIO agrees there is to be no nudity in any free areas,
but not limited to â'Free Chat'. This is an area where as a customer
is' NOT BUYING TIME' (as for our Live â'Pay-Per-View Site this
would not apply), once in your i.e. room, where the customer is
free of charge and able to watch your Live video, and or chat with
the model. All Fantasy XTREME, Inc Web Sites are controlled by age
verification processing from our e-commerce provider using a customer’s
credit card. There is NO areas or â'Portals', or backdoors which
the customer may enter by way of bypassing a credit card age verification
that is known to Fantasy XTREME, Inc. Bras and panty outfits are
required â'clothing' in free areas or â'Free Chat, no other
clothes, like pants are heavy sweaters are allowed this is considered
its dress code policy, and will be enforced. Lingerie is acceptable
clothing for all of your chats including, free, semi, and private.
This is strictly adhered to and will be grounds for termination
of your or closure of your room
2. The STUDIO warrants and represents that
all models working for them are over 18 years of age and has provided
â'acceptable proof' of age in the form of a picture identification.
Model must submit a color scanned copy and delivered to Fantasy
XTREME, Inc. by way of electronic upload or email. PHOTOCOPIES Will
NOT BE ACCEPTED, not even by way of email. The validity must be
in a form of a governmental document bearing the photograph, in
the form of a passport, state driver License, selected service cards
or state identification card. A Model User Password will not be
issued allowing access To a Fantasy XTREME, Inc. Web Site, until
age verification has been submitted and accepted, no exceptions
will be granted or implied.
3. The STUDIO agrees that not at any
given time, will they violate any law concerning obscenity. Obscenity
includes, but is not limited to any actual act or simulated conduct
that is: depictions of nudity, nude show before a live audience,
sexuality or sex involving any person under the age of eighteen
(18) years of age, rape, incest, bondage, torture, etc; bestiality,
sex with animals; fisting: necrophilia, i.e. sex with dead people,
child pornography, urination, defecation; i.e. (pooping).
4. The STUDIO agrees that there is to be no
live man-woman, women-women, man-man, performances depicting actual
sexual situation but not limited to any touching of any sexual part
or genitals, sexual intercourse, or oral stimulation is strictly
prohibited under this contract. The STUDIO agrees that but not limited
to the child protection restoration and penalties enhancement act
of 1990,any federal, state, local laws, orders or rulings, will
be complied in the jurisdiction from where she reside.
5. The STUDIO agrees that in no way shall they
ever misrepresent any of the said services of a Fantasy XTREME,
Inc Web Site or at any point make slanderous statement or about
Fantasy XTREME, Inc, or any persons affiliated with the website
weather employee or, corporate officer, affiliate, or outside contractor,
or any person affiliated with Fantasy XTREME, Inc whatsoever. The
STUDIO agrees never to promote another Website, other than one owned
and operated by Fantasy XTREME, Inc. This also includes giving out
URLs of other Web Sites in all chats, including free, semi, or private
is strictly prohibited, and is grounds for immediate termination
of said contract. Soliciting sexual services while using Web Site
for any sexual favors paid for or free, which in any way, is strictly
prohibited by said contract, and is considered illegal in most states,
and is grounds for immediate termination of this contract.
6. The STUDIO grants and licenses to Fantasy
XTREME, Inc., a perpetual, irrevocable sub-license and non exclusive
right to use, reproduce, publish, adapt, modify, create new derived
images, and incorporate into any form, at any given time archived
or video, including audio, Add images to Web Site & all text
that was done by the model employed or affiliated with the STUDIO..
7. The STUDIO certifies that the models registered
by said STUDIO will be the only person to use the Web Site
or i.e. â'Room'. Neither the STUDIO nor an affiliated Model may
assign this contract under any circumstances. This contract is non-assignable.
8. At any time Fantasy XTREME, Inc, may revise
or change, this contract. Fantasy XTREME, Inc. Will post these said
changes by way of email, or on a separate page on the Fantasy XTREME,
Inc Website. Fantasy XTREME, Inc can revise said contract with regards
to the entire â'contract', this new revised contract shall supercede
any prior contract or contracts to this subject matter herein, and
will become enforceable, immediately
9. The STUDIO shall not at any time, violate,
any laws, pertaining to copyright, and or infringe upon; civil;
broadcast; artistic; property; performance; dramatic; publicity;
or any other rights of any person.
10. The STUDIO acknowledges, agrees, and understands
that their use of the Web Site is their own risk. The model assumes
without exception all responsibility for any consequences and or
damages that may be a result from her use of said Web Site. The
STUDIO agrees to save and hold harmless Fantasy XTREME, Inc or any
of its officers, employees, affiliates, outside contractors, or
any other persons involved with Fantasy XTREME, Inc from and against
all obligations, losses, and or damages including bodily injury
to herself or any loss of equipment or property, that may result
from a STUDIO'S use of a Fantasy XTREME, Inc Web Site.
10a. ever at any point Fantasy XTREME, Inc.
will not be liable for loss of use of Web Site, due to an Internet
problems or any event incidental, or consequential this includes
profit, or income loss.
10b. The STUDIO agrees to pay for all legal
costs, and to indemnify and hold Fantasy XTREME, Inc., owner, officers,
employees, affiliates, directors, shareholders, attorneys, agents,
outside contractors, or any other persons involved with Fantasy
XTREME, Inc', from any loss, liability, claims, damage, injuries,
costs or expense arising from of any breach of this contract.
11. The STUDIO agrees there is no employee-employer
relationship or an independent contractor. The contract between
you and Fantasy XTREME, Inc. does not tell you what your lawful
content or your services shall be, and Odyssey Enterprises, Inc.
does not have control over what images you have provided to the
Network, Fantasy XTREME, Inc, Is not responsible for, and is the
sole responsibility of the model to pay any federal or state taxes,
including but not limited to, social security, disability, unemployment,
or income withholding taxes, from monies paid to you from Fantasy
XTREME, Inc, or on behalf of Model to third parties.
12. No studio and or Model may sign up and work on two different FX
websites. FX websites is designated by the Fantasy Xtreme Network of
websites created using OdysseyCam Technology . Once a studio and or
model has signed up or worked on any FX website they cannot
re-signup or work on any other FX website There is absolutely NO
EXCEPTIONS
13. The failure of either party to insist upon
the performance of any provision herein or to exercise any right or
privilege granted hereunder shall not be construed as a waiver of
such provision or any provisions herein, and the terms will continue
in effect and in full force. No waiver of any breach of any of the
provisions herein shall be considered a waiver of any continuing or
subsequent breach of the same provision. The rights and remedies of
either party as provided herein shall be cumulative with any other
rights or remedies by law or equity. |
